These terms are the agreement between you and Malek Doss, an independent developer who makes and operates Tend. By downloading or using Tend, you agree to them. If you don't agree, please don't use the app. How we handle your information is covered separately in our Privacy Policy, which is part of this agreement.
Tend is a private daily ritual for couples: a place to reflect on how each day felt and to share gratitudes, moments, flags, and plans with your partner.
You must be at least 13 years old to use Tend, or at least 16 if you're in a country where that's the minimum age for consenting to online services. If you're under the age of majority where you live, you may only use Tend with a parent or guardian's permission, and they agree to these terms with you. You also confirm you're not barred from using the app under any laws that apply to you.
Tend accounts start anonymous and can be saved with Apple, Google, or an email and password. Saving your account is what makes it recoverable. An unsaved account lives only on that device, and signing out or losing the device means losing access to it.
You're responsible for keeping your sign-in method secure and for what happens under your account. Accounts are meant for one person each: please don't use your partner's account, and don't let anyone else use yours. Tell us if you think someone has gained access to your account.
Tend works by pairing two accounts. Invite codes are meant to connect you with your actual partner. Don't share your invite code publicly, and don't use someone else's code to reach a couple you're not part of.
Once you're paired, your partner can see what you share: your daily word after you've both logged, and your gratitudes, moments, flags, plans, and about us details as you add them. We can't un-share something once your partner has seen it, so please write with that in mind.
Either of you can unpair at any time from Settings. Unpairing ends the couple for both people.
You own what you write in Tend. You keep that ownership, and we don't claim it.
To run the app for you, you give us a limited, non-exclusive, worldwide, royalty-free license to store, copy, process, and display your content: to you, to your partner, and to the service providers listed in our Privacy Policy, including the AI provider that writes your recaps. That license exists only so Tend can work, it lasts only as long as we hold your content, and it does not let us use your content for advertising, marketing, or training our own models.
You're responsible for what you write, and you confirm you have the right to share it.
Tend Plus is an optional paid subscription that unlocks additional features. One subscription covers both partners in a couple.
We may change prices or what Plus includes. If a change affects a subscription you already have, we'll give you notice through the app or the store before it takes effect, and you'll have the chance to cancel before you're charged the new price. Existing subscriptions keep their price for the period already paid for.
Tend's recaps include text written by an AI model from a summary of your period, as described in our Privacy Policy.
Please read them for what they are: a reflection, not a verdict. AI writing can be inaccurate, incomplete, or simply off, and a recap is not a factual finding about you, your partner, or your relationship. Don't rely on it for decisions that matter, and never treat it as advice. We don't guarantee that recaps will be available, generated on any schedule, or generated at all for a given period.
We're actively building Tend, which means features may be added, changed, or removed, and the app may need updates to keep working. We may suspend or discontinue the service, in whole or in part. If we discontinue Tend entirely, we'll give you reasonable notice and a way to get your data out where we can.
You can unpair from your partner or delete your account entirely at any time from Settings. What deletion does and does not remove is spelled out in our Privacy Policy.
We may suspend or terminate an account that violates these terms, that puts other people at risk, or where we're required to by law. Where it's reasonable to do so, we'll tell you why and give you a chance to put it right. If we terminate your account without cause, we'll refund the unused portion of a current subscription period where the stores allow it.
Tend is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that the app will be error-free, uninterrupted, secure, or that data will never be lost, and we're not responsible for decisions you make, or for outcomes in your relationship, based on using it. Some places don't allow these exclusions, in which case they may not apply to you.
To the fullest extent permitted by law, Tend and its developer aren't liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the app.
To the fullest extent permitted by law, our total liability for any claim relating to Tend is limited to the greater of the amount you paid us for Tend in the 12 months before the claim, or 50 US dollars. Some places don't allow these limits, in which case they may not apply to you, and nothing here limits liability that can't be limited by law.
You agree to cover our reasonable losses and legal costs if a third party brings a claim against us because of your misuse of Tend, your breach of these terms, or content you posted that you had no right to post.
If you got Tend from the Apple App Store, the following applies. This agreement is between you and us, not Apple, and Apple is not responsible for Tend or its content. Apple has no obligation to provide any maintenance or support for Tend. If Tend fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claim by you or a third party relating to Tend, including product liability, any failure to conform to a legal requirement, or claims under consumer protection or similar legislation, and is not responsible for investigating or resolving any third-party intellectual property claim relating to Tend. You confirm that you are not located in a country subject to a US Government embargo or designated as terrorist supporting, and that you are not on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
If you got Tend from Google Play, Google's own terms apply to your download and any purchase, and Google is likewise not a party to this agreement.
We may update these terms. If a change is material, we'll update the date at the top of this page and let you know in the app before it takes effect. Continuing to use Tend after that means you accept the updated terms; if you don't, you can stop using the app and delete your account.
